DUI - Felony
RM was intoxicated and got into an argument with the front desk staff of the hotel she was staying at in Loveland, CO. The hotel staff called the police. Before the police responded, RM decided to go out to her car which was parked in front of the hotel. When the police arrived RM was smoking a cigarette in her car with the engine on. Officers engaged with RM and observed that she appeared to be rather intoxicated. RM refused to comply with the officers commands to exit her car and had to be dragged out. The officers subsequently charged her with felony DUI (she had 3 prior DUI convictions). At trial, we argued that RM had no intention of driving, but was simply sitting in the driver's seat, smoking a cigarette, and listening to music with the air conditioning on. The jury agreed and found her Not Guilty of DUI (despite hearing about her 3 prior DUI convictions).
