DUI
CM was driving in Loveland late at night when a police officer began following him. After a few minutes, the officer flipped on his blue lights and attempted to pull CM over for an alleged traffic infraction. CM pulled over into a closed business, but instead of stopping immediately, he performed a U-turn in the parking lot and faced the officer's patrol car. In response, the officer aimed his spotlight directly at CM and called for backup. After backup arrived, CM was ordered to exit his vehicle. After several minutes and several more commands to exit, CM finally exited his vehicle, was arrested for DUI, and placed in the back of the officer's patrol car. CM declined to speak with officers or to participate in DUI field sobriety tests. At trial, the arresting officer testified that CM's eyes were red/watery and that he appeared very sleepy. We argued that the red/watery eyes were likely caused by the officer pointing his spotlight at CM's eyes for several minutes and that CM always looked like he was on the verge of falling asleep (the jury saw this firsthand throughout the trial). CM was found Not Guilty of DUI.
