Double Homicide
KF was charged with Murder x 2 for allegedly invading a drug dealer's house and shooting three of the individuals who were present at the time. Two of the individuals died from their wounds, but one victim survived to identify KF as the shooter. Additionally, another witness, who had been hiding under a bed at the time of the shooting, also identified KF as the shooter. Prior to trial, the DA was unwilling to offer anything other than LIFE in prison. KF denied any involvement and opted to take his chances with a jury. At trial, we were able to show that both the surviving victim and the eyewitness, who was hiding under the bed, were heavy crack cocaine/alcohol users with lengthy criminal histories of their own and that their identifications of KF warranted heavy scrutiny. Despite having two witnesses identify KF as the shooter, the jury was unable to reach a unanimous verdict. As a result, a mistrial was declared. After the mistrial, the DA was willing to make a much more reasonable offer and KF is now home with his family serving the remainder of his sentence on probation.
