Assault on a Police Officer
AW had warrants out for his arrest and was hanging out at a hotel known for drug activity. When a police officer pulled into the parking lot, AW took off on foot. The police officer gave chase. During the chase, AW is alleged to have pulled a 9mm handgun out of his jacket pocket and pointed it at the officer. The officer took cover and AW was able to get away. Through AW's friend, who remained on scene at the hotel, police were able to identify AW as the perpetrator and an arrest warrant for Assault on a Police Officer was issued for his arrest. After AW was arrested, the DA's offer involved several years in prison. AW declined the offer and opted for a jury trial instead. At trial, the prosecution was unable to locate and subpoena the witness that identified AW as the suspect who ran from the hotel and pointed the gun at the officer. Without this witness, we were able to cast doubt on the reliability of the officer's identification of AW as the perpetrator. AW was found Not Guilty on all charges.
